I am a guest of the Senachwine Club (“SC”). It is my decision to participate and hunt waterfowl on SC property during the 2025 Illinois waterfowl seasons. I warrant that my physical condition will allow me to participate fully in waterfowl hunting activities at SC. I realize that SC has not and will not make any investigation into my physical fitness or ability to participate in the strenuous sport of waterfowl hunting and is relying upon the warranties I have made.
I, on behalf of myself, my family, my estate, and my heirs, executors, personal representatives, and assigns, hereby release and discharge SC and its officers, directors, staff, employees, agents and representatives (collectively “Released Parties”) from any and all claims, demands, damages, rights and causes of action, including attorneys’ fees, (collectively “claims”) in any way arising out of or relating to my hunting activities or personal behavior whether or not such claims are caused by the negligence of the Released Parties or otherwise. Further, I hereby agree to indemnify, defend and hold harmless the Released Parties for any loss or damage, including attorneys’ fees, including any that results from claims or lawsuits, whether brought by a third-party or not, for illness, personal injury, death or property loss or damage in any way arising out of or relating to my hunting activities, whether or not such loss or damage is caused by the negligence of the Released Parties or otherwise.
The risks and dangers described herein may be caused by my own negligence, the negligence of others, or of SC. I acknowledge that there may be risks and dangers not known to me and not reasonably foreseeable at this time. I acknowledge, understand, and agree that all of the risks and dangers described in the Senachwine Club Liability Waiver and Release for 2025 Waterfowl Season (“Release”), including those caused by my negligence or the negligence of others, including SC and its members and staff, are included within this Release.
I expressly agree that this Release and the foregoing assumption of risk, release and waiver of liability, and indemnity agreement are intended to be as broad and inclusive as is permitted by the laws of the State of Illinois.
I acknowledge that I have carefully read the Release, and freely and knowingly assume the risks and fully understand that it is a release of liability, and that no oral representations, statements, or inducements apart from the foregoing written agreement have been made, and that I am fully competent to execute this document. I agree that I am voluntarily giving up and waiving any right that I, and/or anyone acting on behalf of me or of my estate, otherwise might have to bring a legal action against the Released Parties for wrongful death, personal injury, or illness arising out of my activities at SC. I agree that this Release shall be governed by and construed in accordance with Illinois law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of this document as a whole.
